1. Acceptance of Terms
By downloading, installing, or using the Travel Pilot mobile application ("App") or accessing the Travel Pilot website and API services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.
Travel Pilot reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify users of material changes through the App or via email.
2. Eligibility
You must be at least 16 years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years of age, you represent that your legal guardian has reviewed and agreed to these Terms.
3. Account Registration
To access certain features, you must register an account. You may register using:
- Email address and password
- Google Sign-In (OAuth 2.0)
- Apple Sign-In
You agree to provide accurate and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. You must notify Travel Pilot immediately of any unauthorized use of your account.
Travel Pilot implements account security measures including login attempt limits (5 failed attempts result in a 15-minute lockout), token rotation, and multi-device session management (maximum 5 concurrent devices).
4. Description of the Service
Travel Pilot is a travel planning platform that provides the following features:
- Travel Plan Creation: Create and manage multi-destination travel itineraries with customizable preferences for budget, walking style, meal schedules, and trip styles.
- AI-Powered Itinerary Generation: Generate personalized day-by-day itineraries using artificial intelligence (Google Gemini), with a deterministic fallback system when AI is unavailable.
- Plan Sharing & Collaboration: Share travel plans with partners via secure links with configurable permissions (read-only or edit access).
- Flight, Hotel & Activity Search: Search and compare flights (via Skyscanner), hotels (via Booking.com), and activities (via GetYourGuide) with deep links to third-party booking providers.
- Push Notifications: Receive trip reminders, booking confirmations, itinerary updates, price alerts, and sharing invitations.
5. Premium Subscription
Certain features are available only to premium subscribers. Details regarding pricing, billing, renewal, and cancellation are set forth in our Purchase Policy.
Free users are limited to one (1) active travel plan. Premium subscribers may create unlimited travel plans and access AI-powered itinerary generation.
6. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to the Service, other user accounts, or related systems or networks.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or disassemble any portion of the Service.
- Use automated systems (bots, scrapers) to access the Service beyond the rate limits provided.
- Share, distribute, or sublicense your account access to third parties.
- Upload or share content through the plan sharing features that is offensive, harmful, or infringes on third-party rights.
Travel Pilot enforces rate limits on API usage (120 requests per minute for authenticated users, 30 for unauthenticated users) and AI generation (5 requests per hour for premium users). Exceeding these limits may result in temporary or permanent access restrictions.
7. Third-Party Services
The Service integrates with and may redirect you to third-party services, including but not limited to:
- Google Maps & Google Places: For mapping, directions, place information, and photos.
- Google Gemini: For AI-powered itinerary generation.
- Skyscanner: For flight search and booking deep links.
- Booking.com: For hotel search and booking deep links.
- GetYourGuide: For activity and ticket search and booking deep links.
- Wikipedia: For place descriptions and images.
Travel Pilot does not process bookings or payments for flights, hotels, or activities. All bookings are completed directly with the third-party provider. Travel Pilot is not responsible for the availability, accuracy, pricing, or quality of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
8. Intellectual Property
The Service, including its design, code, graphics, logos, and content (excluding user-generated content and third-party data), is the exclusive property of Travel Pilot and is protected by applicable intellectual property laws. All rights are reserved.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial travel planning purposes in accordance with these Terms.
AI-generated itineraries are provided for personal use. Travel Pilot retains no ownership over your travel plan data, which remains yours.
9. User Content & Data
You retain ownership of all content you create within the Service, including travel plans, preferences, and notes. By sharing a travel plan with other users, you grant those users permission to view (and, if granted edit access, modify) the shared plan content.
Travel Pilot does not claim ownership of your content but requires a limited license to host, store, and transmit your content as necessary to provide the Service.
10. Account Deletion
You may delete your account at any time through the App. Account deletion permanently removes all associated data, including travel plans, itineraries, bookings, subscriptions, device tokens, and notifications. This action is irreversible.
Travel Pilot may also terminate or suspend your account if you violate these Terms, with or without prior notice.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Travel Pilot does not warrant that:
- The Service will be uninterrupted, error-free, or secure.
- AI-generated itineraries will be accurate, optimal, or suitable for your specific needs.
- Third-party information (flight prices, hotel availability, place details, opening hours) will be current or accurate.
- Weather forecasts provided will be precise.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAVEL PILOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT SHALL TRAVEL PILOT'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO TRAVEL PILOT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Travel Pilot is not liable for any losses resulting from third-party bookings, travel disruptions, inaccurate AI recommendations, or reliance on information provided through the Service.
13. Indemnification
You agree to indemnify, defend, and hold harmless Travel Pilot and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of laws principles.
Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Brazil.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
